The Gaudreau family has lived through a nightmare, and justice has not yet been served.
Sean Higgins killed Johnny Gaudreau and his brother Matthew last year in New Jersey. The 44-year-old allegedly brutally crashed into and killed the brothers as they rode their bikes together.
The trial seems to be far from over as Sean continues to plead not guilty, along with words that are causing much controversy.
More details of what happened will be revealed
The investigation is still ongoing and new information is being revealed with updates that could leave more than one with bittersweet feelings.
Sources reveal that Sean Higgins had several beers before he caused the fatal accident in which he ran over the Columbus Blue Jackets field hockey star and his brother while they were riding a bicycle in Oldmans Township,New Jersey last August.
Sean is demanding that the brothers' blood alcohol levels be tested, as they were drunker than he was, according to multiple sources.
Things are not going so well for him, however, as the driver ed a blood alcohol concentration of 0.087%, just over the legal limit, according to court documents from the recent hearing.
While Johnny had a blood alcohol level of 0.129% at the time of his death, his brother's was only 0.134%.
Justice could not rule against the brothers
It would be terrible if the driver did not pay for what he caused, but the reality is that the situation is on the right track. The brothers would not be breaking the law by riding on the road with a small percentage of alcohol.
Under state law, a bicycle is not a motor vehicle. Still, riding it drunk could result in a charge of disorderly conduct, according to the Kugel Law Firm, experts in DWI cases in New Jersey and New York.
Sean ruined the lives of the entire Gaudreau family; before the brothers' deaths, they were preparing to go to one of their sister's best days, as the wedding date was very close.
If that wasn't enough, the painful tragedy became even more shocking when the family announced that Madeline, Matthew's wife, was expecting their first child at the time of his death. The baby was born late last year.
It remains to wait for the resolution of the case, but let's hope that there will be justice, Sean, the driver who caused all this, is still defending himself and does not accept his responsibility, and the court filings will put more pressure on him.
